Terms and conditions for ordering online group classes:

By placing an order for online group classes from Goods of the Mind, LLC ("GOTM"), you ("the Customer") agree that the Customer will pay to the GOTM the agreed-upon price of a series of online group classes in exchange for GOTM to facilitate access to each online group class (in the series of online group classes purchased by the Customer) for the Customer, where "facilitating access" includes making available for the use of the Customer (or for the use of one (1) student designated by the Customer), by means of the Internet, a facilitating software that can be used by the Customer (or the student designated by the Customer) to access the online group class, and where "facilitating access" excludes supplying a computing device or a means of accessing the Internet (that is, it is the responsibility of the Customer to obtain the use a computer that is capable of accessing the Internet at the scheduled time of the online class) and where "facilitating access" additionally excludes any action other than making software available for the use of the Customer (or for the use of the student designated by the Customer) through the Internet. In particular, "facilitating access" does not require that the Customer (or the student designated by the Customer) actually make use of the software that is made available for the use of the Customer (or for the use of the student designated by the Customer); in other words, access will be considered to have been facilitated if the software that facilitates access was made available for the use of the Customer (or the use of the student designated by the Customer), irrespective of whether the Customer (or the student designated by the Customer) used it or not. The Customer agrees that GOTM may refuse service to the Customer or fail to provide service to the Customer at any time for any reason and that the Customer's sole recourse in the event of GOTM's refusing or failing to provide service to the Customer shall be for the Customer to apply for a refund according to the applicable refund policy. The Customer agrees that GOTM's liability is limited only to amounts paid to GOTM. The Customer agrees that the purchase is final except in the event of a refund and that refunds will take place as specified by the GOTM online group class refund policy. The GOTM online group class refund policy is that GOTM reserves the right not to refund a customer unless the customer applies for a refund in writing (which shall be taken to include electronic mail ("e-mail") to the user "sales" present on the domain name "goodsofthemind.com") and, additionally, the circumstances meet one or more of the criteria in which GOTM considers that a customer is entitled to a refund. GOTM considers a customer who has purchased a series of online group classes to be entitled to a full refund if the online group class access/delivery software did not work on their computer during the first online class of the series of online group classes, provided that the customer notified GOTM of that fact in writing (or by electronic mail ("e-mail")) at least twelve (12) hours before the second class of the the same series of online group classes. GOTM considers a customer to be entitled to a partial refund of the pro rata charge for the online class if an online class purchased by the customer is not actually conducted by GOTM at the scheduled time of the online class for any reason (in the rare case in which the entire remainder of a series of online group classes is cancelled by GOTM, the customer is entitled to a partial refund equal to the total pro rata charge for all of the cancelled online classes combined). GOTM considers a customer entitled to a refund of eighty (80) percent of the total pro rata charge for all of the remaining online classes of a series of online group classes purchased by a customer if the customer wished to cancel out of all online group classes remaining from the same series of online group classes that the customer purchased, provided that at least two online group classes remain before the end of the series of online group classes that the customer purchased (for the purposes of this condition, an online group class is considered to be "remaining" if it is scheduled to take place at least twelve (12) hours after the time at which the customer made known to GOTM in writing (or by electronic mail) of his or her wish to cancel out of a series of online group classes purchased by the customer). GOTM does not consider any customer to be entitled to a refund under any other circumstances. In particular, GOTM does not consider a customer to be entitled to a refund in the event that a class purchased by the customer is conducted by a substitute instructor or any instructor other than the regular instructor for that class. GOTM may still grant refunds to customers in other circumstances as GOTM determines that the circumstances warrant, but GOTM will do so at its sole discretion; according to the terms of this agreement, GOTM is not obligated to do so.

Terms and conditions for ordering online individual classes:

By placing an order for individual tutoring services with Goods of the Mind, LLC ("GOTM"), you ("the Customer") agree that the Customer will pay to GOTM the agreed-upon price of tutoring services in exchange for GOTM to provide the Customer with tutoring services. The Customer agrees that the Customer will schedule the time and date at which tutoring services are to be provided with GOTM in writing (which shall be taken to include electronic mail ("e-mail") to the user "sales" present on the domain name "goodsofthemind.com"). The Customer agrees that GOTM may refuse service to the Customer or fail to provide service to the Customer at any time for any reason and that the Customer's sole recourse in the event of GOTM's refusing or failing to provide service to the Customer shall be for the Customer to apply for a refund according to the applicable refund policy. The Customer agrees that GOTM's liability is limited only to amounts paid to GOTM. The Customer agrees that the purchase is final except in the event of a refund and that refunds will take place as specified by the GOTM individual tutoring services refund policy. The GOTM individual tutoring services refund policy is that GOTM reserves the right not to refund a customer unless the customer applies for a refund in writing (which shall be taken to include electronic mail ("e-mail") to the user "sales" present on the domain name "goodsofthemind.com") and, additionally, the circumstances meet one or more of the criteria in which GOTM considers that a customer is entitled to a refund. GOTM considers a customer who has purchased individual tutoring services to be entitled to a full refund in the event that GOTM is not able to actually provide tutoring services to the customer at the date and time agreed upon by both GOTM and the customer. GOTM considers a customer to be entitled to a full refund if the customer makes known to GOTM, by means of electronic mail ("e-mail") to the user "sales" present on the domain name "goodsofthemind.com", that the customer wishes to cancel or reschedule a session at least twenty-four (24) hours before the scheduled time of the session. GOTM considers a customer to be entitled to a full refund if the customer decides not to make use a session of individual tutoring services purchased by the customer.

Terms and conditions for ordering essay grading and improvement:

By placing an order for essay grading with Goods of the Mind, LLC ("GOTM"), you ("the Customer") agree that the Customer will pay to GOTM the agreed-upon price of essay grading in exchange for GOTM to provide the Customer with one (1) set of grading notes for one (1) essay supplied to GOTM by the Customer. The Customer agrees that the Customer will provide GOTM with essay to be graded by electronic mail ("e-mail") and that the Customer will accept grading notes through the same medium of electronic mail ("e-mail"). The Customer agrees that GOTM may refuse service to the Customer or fail to provide service to the Customer at any time for any reason and that the Customer's sole recourse in the event of GOTM's refusing or failing to provide service to the Customer shall be for the Customer to apply for a refund according to the applicable refund policy. The Customer agrees that GOTM's liability is limited only to amounts paid to GOTM. The Customer agrees that the purchase is final except in the event of a refund and that refunds will take place as specified by the GOTM essay grading refund policy. The GOTM essay grading refund policy is that GOTM reserves the right not to refund a customer unless the customer applies for a refund in writing (which shall be taken to include electronic mail ("e-mail") to the user "sales" present on the domain name "goodsofthemind.com") and, additionally, the circumstances meet one or more of the criteria in which GOTM considers that a customer is entitled to a refund. GOTM considers a customer who has purchased essay grading services to be entitled to a full refund if the customer submitted an essay for grading and GOTM did not send a reply with grading notes within forty-eight (48) hours of receiving the customer's essay. GOTM does not consider any customer to be entitled to a refund under any other circumstances. In particular, GOTM does not consider a customer to be entitled to a refund in the event that the grading notes provided by GOTM are considered inadequate by the customer for any reason. In particular, GOTM does not consider a customer to be entitled to a refund in the event that the customer is unable to access the grading notes sent by GOTM to the customer due to technical problems with the customer's computing device or internet service provider ("ISP") or electronic mail ("e-mail") service provider. GOTM may still grant refunds to customers in other circumstances as GOTM determines that the circumstances warrant, but GOTM will do so at its sole discretion; according to the terms of this agreement, GOTM is not obligated to do so.
